Terms of Service

These Terms of Service (the "Terms") govern your access to and use of mobilehwyads.com (the "Site") and the advertising services offered by Mobile Hwy Advertising Media Network, a dakdan worldwide company ("Mobile Hwy Ads," "we," "us," or "our"). By visiting the Site, requesting a quote, or engaging us to place your artwork on our fleet, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Site or our services. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity.

Mobile Hwy Ads operates a nationwide mobile out-of-home advertising network. We place advertiser artwork on a fleet of more than 21,000 semi trucks and trailers that travel across all 50 states, giving your brand eye-level placement on interstates, US highways, and at truck stops nationwide.

Our Site is an informational and lead-generation platform. It does not offer a shopping cart, online checkout, or instant purchase. Everything we sell is quote-driven and handled directly with our team.

Any pricing, availability, timelines, or estimates we share, whether on the Site, by email, or in a proposal, are non-binding estimates for planning purposes only. They do not constitute an offer capable of acceptance and do not create a contract. A campaign becomes binding only when both parties execute a written insertion order or advertising agreement that sets out the specific formats, quantities, placements, term, and price.

You are responsible for the artwork, copy, logos, and creative assets you supply for your campaign ("Advertiser Content"). You must deliver print-ready files that meet the specifications and templates we provide for each format. We are not responsible for print or production issues that result from files that do not meet those specifications.

You represent and warrant that you own or have the necessary rights, licenses, and permissions to use and display all Advertiser Content, and that our reproduction and public display of it on our fleet will not infringe or misappropriate the rights of any third party.

Advertiser Content must not be unlawful, defamatory, obscene, deceptive, or infringing, and must not promote hatred, violence, or discrimination. It must comply with all applicable advertising laws and regulations. We reserve the right, in our sole discretion, to review, reject, or require changes to any Advertiser Content, and to remove or decline to run content that we determine violates these standards or exposes our network or drivers to risk.

The Site and its content, including text, graphics, layout, design, the Mobile Hwy Ads name and logo, and all related trademarks, are owned by us or our licensors and are protected by United States and international intellectual property laws. Nothing in these Terms grants you any right to use our marks without our prior written permission.

You retain all ownership of your Advertiser Content. By supplying it to us, you grant Mobile Hwy Ads a non-exclusive, royalty-free license to reproduce, print, install, and publicly display that content on our fleet for the purpose of delivering your campaign, and to include representative campaign imagery in our own portfolio and marketing unless you tell us in writing that you prefer we do not.

The Site and our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any specific number of impressions, views, leads, sales, or other outcomes from a campaign.

To the fullest extent permitted by law, Mobile Hwy Ads and its parent, affiliates, and their respective officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or related to your use of the Site or our services. Our total aggregate liability for any claim arising out of or related to a campaign will not exceed the amount you actually paid to us for that campaign.

You agree to indemnify, defend, and hold harmless Mobile Hwy Ads, its parent company, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your Advertiser Content, your breach of these Terms, or your violation of any law or the rights of any third party.

These Terms and any dispute arising out of or related to them or our services are governed by the laws of the State of Colorado, United States, without regard to its conflict of law principles. You agree that the state and federal courts located in Colorado will have exclusive jurisdiction over any such dispute, and you consent to venue in those courts.

We may update these Terms from time to time to reflect changes in our services, our practices, or applicable law. When we do, we will revise the "Last updated" date below. Your continued use of the Site or our services after any change takes effect means you accept the revised Terms. We encourage you to review this page periodically.
